Your continued use of our Website constitutes your agreement to be bound by the Terms of Use. By purchasing from us, you are deemed to have agreed to the terms stated on our terms & conditions page and ordering and delivery page.

1. DEFINITIONS

theblushinc.com is the interactive online service operated by The Blush Inc. on the World Wide Web of the Internet.

2. GENERAL

As we continue to develop our Website, we may from time to time, modify, alter or update these Terms of Use. Your use of our Website following any such change constitutes your agreement to follow and be bound by the Terms of Use as changed. We therefore encourage you to refer to these Terms of Use on an on-going basis. 

3. WEBSITE CONTENTS 

'theblushinc.com' and 'The Blush Inc.' are trademarks, service marks, and/or trade names of The Blush Inc. All other trademarks, service marks, and trade names contained in the Website are the properties of the respective owners. 

Unless otherwise noted, the design of this Website, the Website as a whole, and all materials, including images, illustrations, and designs, that are part of the Website (collectively, 'Contents') are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled, or licensed by The Company. The Contents of our Website are intended solely for personal, non commercial use by the users of our Website. You may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the Contents contained on the Website or any other server. Any unauthorized use of any material contained on this Website may violate domestic and/or international copyright laws, the laws of privacy and publicity, and communications regulations and statutes.

4. COLORS 

We have made every effort to display as accurately as possible the colors of our products that appear on the Website. However, as the actual color you see depends on the resolution of your monitor, we cannot guarantee that your monitor's display of any color will be as accurate as what we present.

The Company shall have the right, but not the obligation, to monitor the content of the Website, including e-mail, to determine compliance with this Agreement and to satisfy any law, regulation or authorized government request. Without limiting the foregoing, The Company shall have the right to remove any material that The Company, in its sole discretion, finds to be in violation of the provisions hereof or otherwise.

The Company Website shall be used for lawful purposes only. Any conduct by you that in The Company's discretion restricts or inhibits any other user from enjoying this Website will not be permitted.

7. LINKS TO OTHER WEBSITES AND SERVICES

To the extent that this Website contains links to outside services and resources, the availability and content of which The Blush Inc. does not control, any concerns regarding any such service or resource, or any link thereto, should be directed to the particular outside service or resource.

8. DISCLAIMER, LIMITATION OF LIABILITY, AND INDEMNITY

This Website and all contents of the Website are provided on an "as in" basis without warranties of any kind, either express or implied, including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose. The Company does not warrant that your use of this Website will be uninterrupted or error free, or that this Website or its server are free of viruses or other harmful elements. Your use of this Website is at your sole risk. You assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment that you use in connection with your use of our Website. The Company shall not be liable for any damages of any kind related to your use of this Website.

Although The Blush Inc. endeavors to provide accurate information, it does not warrant or make any representations regarding the accuracy or reliability of information on this Website. Neither The Blush Inc. nor its content providers shall be liable to any person or entity for any direct or indirect loss, damage (whether actual, consequential, punitive, special or otherwise), injury, claim, or liability of any kind or character whatsoever based upon or resulting from your use or inability to use this Website, or any information or materials provided on the Website. The Company is not liable for any defamatory, offensive or illegal conduct of any user. If you are dissatisfied with the Website or with any of The Blush Inc.'s Terms of Use, your sole and exclusive remedy is to discontinue using the Website.

You agree to indemnify, defend, and hold harmless the Company and related entities from and against any and all third party claims, demands, liabilities and costs or expenses, including attorney's fees, resulting or arising out of your breach of any of these Terms of Use.

9. INACCURACY DISCLAIMER

From time to time there may be information on theblushinc.com that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after the submission of order). 

10. BACKORDER

A backorder is an advance purchase of an item that we have decided to restock due to overwhelming response. Depending on the time that a backorder is purchased, the standard lead time is 4-5 weeks from the date the item is released on backorder. 

However, delays & cancellations may occur due to unforeseen circumstances beyond our control. Updates on the estimated time of arrival will be updated as promptly as we can to inform customers on all possible delays/cancellations. Customers are deemed to have accept the possibilities of delays/cancellations prior to purchasing a backorder item. A full refund/cancellation of backorder on a customer's request on any uncancelled backorder at any point will not be accepted. 

In the event of a cancellation of backorder, a full refund will be done via store credits. There will be no direct cash refunds to bank accounts or credit/debit cards. 

Do note that there may be an occurence for a slight variance in colours for the backorder as the backorder is a different batch being manufactured from the original batch due to fabric & dye processing. This slight variance cannot be considered as a defect and hence does not qualify as a reason for return/refund.

 

11. UNFULFILLED ORDERS

Any unfulfilled orders for instock items will also be refunded via store credits.

In the event that the unfulfilled item in the order has resulted in the order to not qualify for free mailing (i.e. free normal mail or free courier mail), the chargeable postage will be deducted from the amount of store credit that is due to be refunded to customer.

In the event that the unfulfilled item in the order has resulted in the order to not qualify for the standing promotion (i.e. enjoy 10% for every 2 pieces purchased or enjoy $25 off for every $150 purchase), the discount will be removed to the next tiered discount (only if applicable) and will be deducted from the store credit that is due to be refunded to customer.

We have ceased to do cash refunds w.e.f. 1st September 2013.

 

12. RETURN & EXCHANGE POLICY

The policy applies to only merchandise purchased directly from The Blush Inc. webstore (http://www.theblushinc.com).


For such requests, kindly send us an email at sales@theblushinc.com or file a request via our Contact Us and we will get back to you as soon as we can.  All requests must be made known to us within 7 days of receipt of the order.

Criteria for return (defective & incorrect items):- 

a) Inaccurate measurements given, with a difference of at least 1 inch (2.5cm). Do note that there may be a 0.5-0.8 inches difference in our given measurements and such variance will not be considered as a defect/reason for exchange. 
 
b) Incorrect item received. In the event that we are unable to provide a repalcement, a store credit of the item's equivalent value will be issued.
 
c) Defective item received. Customers are required to send us pictures of the defective merchandise prior to mailing the item back to confirm that the item has a defect & the defect is in no way part of the intended design. In the event that we are unable to provide a repalcement, a store credit of the item's equivalent value will be issued.
 
We apologise for the inconvenience caused & will reimburse relevant postage costs incurred by customers in sending the items back to us. All reimbursements will be made via store credits.
 
Criteria for return for store credits (reasons not related to defective & incorrect items):-
 
a) Items purchased are not SALE items.
 
Kindly indicate your order no. in your email subject & reason/s for return if any. Do take note that the store credits returned will be subjected to a $3 administration fee per item & will only be valid for 30 days (non refundable nor extendable). Store credits from a returned order must be utilised in one single order, any excess amount will not be refunded.
 
Criteria for exchange:-

a) Wrong size was bought, & wish to exchange for the right size (provided we still have available stocks as such requests are accepted upon goodwill, there will not be store credits/refunds issued for any shortfall. We reserve the right to reject any exchange requests in the event that an exchange cannot be done). 
 
To qualify for the exchange after either of the above criteria is met, item must also be in its original condition i.e. unworn/unwashed and resellable condition. FREE sized items are not eligible for any exchanges. SALE items or items under special promotions are strictly not allowed for exchange.

Kindly also note that we do not allow exchanges/returns based on any misfit reasons, requiring a change across designs.
 
All relevant postage costs involved will be fully borne by customers. Customers are required to send back the item to reach us within 3 working days for local addresses & 14 working days for overseas addresses by registered mail. Customers are to bear full responsibility in taking efforts to ensure safe delivery of the item/s, The Blush Inc. will not be responsible for such parcels lost in transit. Items will only be reserved upon a notification of the registered tracking number via email. In the event that the item of exchange is no longer available, item will be returned back to customer. 
 
All exchanged parcels must be accompanied by a self return envelope with the relevant postage stamps affixed (to be advised by us) or opt for courier delivery whereby delivery payment of $6 has to be paid directly to the courier delivery personnel upon delivery of the item.

The Blush Inc. reserves the right to exercise discretion in this matter. Item/s returned with neither prior notification via email nor return acknowledgement via email by The Blush inc. will be duly rejected. 

 

13. TERMINATION

These Terms of Use constitute an Agreement which is effective unless and until terminated by The Company. The Company may terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to this Website, if in The Company's sole discretion, you fail to comply with any term or provision in this Agreement. Upon any termination of this Agreement, you must promptly destroy all materials obtained from this Website, as well as copies of such materials. These Terms of Use constitute the entire Agreement between you and The Company relating to the subject matter addressed herein.

 

13. APPLICABLE LAW

This Agreement shall be construed in accordance with the laws of Singapore, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the authorities located in Singapore.
